common divorce problems

We aim to provide you with the documents you require to enable you to get your divorce quickly and cheaply. We hope to be able to sort out most of the difficulties encountered in a divorce action with our e-mail service. In certain circumstances we may advise you to consult a solicitor or make a further application to the court. Our fee will not cover those additional steps and you will, for example, be responsible for any solicitors' or court fees.

the petition is incorrectly drawn
The contents of the divorce petition must follow the format as set out by statute. If you do not do so it will be rejected by the court. If your petition has been rejected and returned to you we can help either if you use our Just Support service where we tell you what has gone wrong or we can pick up the pieces and carry on for you with one of our full case management services.

no agreement on financial matters or children
If you have not agreed financial property or children's arrangements with your spouse this may delay the divorce. If these matters cannot be agreed after discussions, we will advise you to consult a solicitor. You can still continue with the divorce using our service. Just ensure that your solicitor knows you are conducting the divorce independently

the divorce is defended
Your husband or wife may indicate on the acknowledgement of the petition that he or she denies that you have grounds for divorce. If you want to pursue the divorce we will advise you to consult a solicitor.

the acknowledgement contains mistakes
Sometimes the acknowledgement form is incorrectly filled in which will stall the proceedings. If you encounter this problem either if you use our Just Support service where we tell you what has gone wrong or we can pick up the pieces and carry on for you with one of our full case management services.

no acknowledgement
If you have the correct address but your spouse has failed to return the acknowledgement form to the court or your spouse has moved and you do not have his or her address, the divorce cannot proceed. There are a number of options that are available at this stage. We will tell you which is the most appropriate under our Just Support scheme or, if you would like us to help you with your case, which of our services is most appropriate for you.
