Financial issues arising from the divorce
Will financial issues delay the divorce process?
Financial issues are not specifically dealt with as part of the divorce process. The final decree absolute of divorce can usually be granted without formally sorting out any financial matters at all.
Having said that, it is quite normal for financial issues to arise during divorce proceedings. Typical examples include what to do with the family home, the division of assets, the paying of debt, and maintenance payments for your spouse and/or your children.
It is possible to agree private financial settlements without involving the court. However, to protect both parties, we strongly advise you to obtain an order from the court in the divorce proceedings to confirm your private financial settlement - or to dismiss potential future claims for financial orders. We can help you to do this online via our financial clean break order service or you can consult a family law firm such as josiah-lake gardiner LLP for further advice. If you are unable to reach a private financial settlement with your spouse, you should consider seeking expert advice.
