divorce mediationMediation enables couples, who have decided that a divorce is the only way forward, to resolve disputes that they cannot resolve between themselves and do not want to involve professional advisers to negotiate for them. The mediation process involves asking a trained third party to help the negotiation process. The trained mediator will manage the discussions and act as an informed referee. It has been found that this sort of help is very effective in identifying issues and speeds the path to resolving disputes. Often the mediator will meet each party on their own first to highlight the issues and then conduct a meeting with all parties present to see if there is a way forward. If an agreement is arrived at with the help of the mediator it is not legally binding unless it is confirmed later with a court order. Remember that a Mediator is not a judge and therefore does not make a decision for the parties nor does he, generally, give legal advice. |
