Children of the family

Overview

If there are any children under the age of 18, you will probably need to complete a separate form and send it to the court with your divorce petition, explaining where they will live etc after the divorce has been finalised. We will draft this form as part of our service.

Able to Agree


The court will expect you both, where possible, to make private arrangements as to where your children will live and how often they will see the non-resident parent. The court will not make any order concerning your children unless there is a good reason for doing so.

Unable to Agree


If you are unable to make private arrangements to the satisfaction of both parties, you or your spouse may need to issue a separate application within the divorce proceedings to resolve any dispute concerning your children.
